By accessing or using the Diviner One website (divinerone.com) and platform ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Services.

These Terms apply to all visitors, users, and others who access or use our Services. If you are using the Services on behalf of a business, you represent that you have the authority to bind that business to these Terms.

Your Account

To use certain features of our Services, you must create an account. You agree to:

• Engage in review gating (selectively soliciting reviews based on sentiment in a way that violates platform policies)
• Use automated tools to generate reviews or review content that misrepresents the customer's experience
• Send unsolicited communications (spam) through our campaign features
• Upload customer contact information without appropriate consent
• Attempt to access other users' accounts or data
• Interfere with or disrupt our Services or servers
• Reverse engineer, decompile, or attempt to extract source code from our platform
• Use our Services in violation of any applicable law or regulation

Subscriptions and Payments

Diviner One offers subscription-based plans with a credit system for certain tracking features. By subscribing, you agree to:

• Pay all fees associated with your chosen plan
• Provide valid payment information
• Accept that subscriptions renew automatically unless cancelled before the renewal date

Credits included in your plan are allocated monthly and do not roll over to the next billing period. Pricing may change with 30 days' notice. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.

Intellectual Property

The Diviner One platform, including its design, code, features, documentation, and branding, is owned by Diviner One and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from our platform without written permission.

Content you create using our Services (Prompt Pages, campaign templates, etc.) remains yours. By using our platform, you grant us a limited license to host, display, and transmit your content solely to provide the Services.

Third-Party Services

Our Services integrate with third-party platforms including Google Business Profile. Your use of these integrations is also subject to the respective third party's terms and policies. We are not responsible for the availability, accuracy, or practices of third-party services.

Limitation of Liability

To the maximum extent permitted by law, Diviner One and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

• Your use of or inability to use our Services
• Any unauthorized access to or alteration of your data
• Actions or content of third parties on or through our Services
• Any other matter related to our Services

Our total liability for any claim related to these Terms or our Services shall not exceed the amount you paid us in the 12 months preceding the claim.

Disclaimer of Warranties

Our Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that our Services will be uninterrupted, error-free, or secure.

Termination

You may terminate your account at any time by contacting us or through your account settings. We may terminate or suspend your access immediately, without prior notice, if you breach these Terms.

Upon termination, your right to use the Services ceases immediately. We will retain your data for 90 days after account closure to allow for reactivation, after which it will be deleted or anonymized in accordance with our Privacy Policy.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to conflict of law provisions. Any disputes arising from these Terms or your use of our Services shall be resolved in the courts of Australia.

Changes to These Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of our Services after changes are posted constitutes acceptance of the revised Terms.
